The location of Walls-arrest Kaufman's is unknown. The location of Walls-office Kaufman's was the subject of FBI activity, according to a bureau official. The presence of law enforcement officers in the office was also corroborated by a third party witness.

Online sleuths made the arrest of Walls-Kaufman in August. As seen in other cases, Walls-Kaufman removed his hoodie as he joined the crowd attempting to push their way past police and into the Capitol, down the hallway outside Speaker Nancy Pelosi's office. When rioter Ashli Babbitt was shot dead by police after leaping through a shattered window, he could be seen at the head of the crowd near the President's lobby.

Walls-fist Kaufman's was caught on the baton of the late DC Metropolitan Police officer Jeffrey Smith, who was killed in the line of duty during the Capitol riots.Smith was struck by a flying metal pole outside the Capitol later that night, on January 6. "I was punched in the face and hit in the head with this metal bar" was how he later described his ordeal to his wife.

On January 6, 2021, David Walls-Kaufman faces off against police as he makes his way into the US Capitol. Smith's widow has filed a civil lawsuit against Walls-Kaufman, who promoted 2020 election conspiracies on his Facebook page.

More than 820 people have been arrested and more than 300 have pleaded guilty in connection with the attack on the United States Capitol. Seditious conspiracy and misdemeanour picketing are among the charges levelled at protesters.
